  • Agricultural Nature of Goods: The buyer acknowledges that the Company deals in livestock (such as live poultry, day-old chicks, point-of-lay hens) and perishable farm produce (such as table eggs and hatching eggs). These products are highly dependent on biological cycles and environmental factors.

  • Availability: All products are subject to availability and seasonal flock cycles. The Company reserves the right to limit order quantities or cancel orders if biological constraints affect supply.

  • Pricing: All prices displayed on our website, advertisements, or quotation documents are subject to change without prior notice. Formal quotes are valid only for the period explicitly stated on the quotation document.

3. Payment Terms

  • Payment Methods: Payments must be made via Electronic Funds Transfer (EFT) or any other secure payment gateway authorized on our website.

  • Order Confirmation: No livestock or perishable goods will be allocated, dispatched, or prepared for collection until full payment reflects in the Company’s bank account.

  • Default or Delays: Delayed payments may result in the forfeiture of your scheduled delivery slot or stock allocation to the next customer in queue.

4. Livestock, Biosecurity, and Risk Transfer

  • Biosecurity Warranty: The Company warrants that all live poultry passes strict health and veterinary standards prior to dispatch. However, once livestock leaves the Company's transport vehicles or collection point, all risk of loss, illness, injury, or mortality shifts entirely to the Buyer.

  • No Post-Handover Returns: Due to strict national biosecurity protocols and the risk of introducing avian pathogens (e.g., Avian Influenza), the Company enforces a zero-return policy on all livestock once the handover is signed off.

  • Management Post-Delivery: The Company is not liable for flock mortality, drop in egg production, or bird illness resulting from the Buyer’s farm management practices, feed quality, environmental stress, or lack of proper on-farm biosecurity.

5. Intellectual Property

All content, logos, text, graphics, images, product descriptions, and software on www.capeagricsolutionsptyltd.com are the exclusive property of Cape Agric Solutions (Pty) Ltd or its content suppliers and are protected by South African and international intellectual property laws. Unauthorized reproduction or distribution is strictly prohibited.

6. Limitation of Liability

To the maximum extent permitted by South African law, Cape Agric Solutions (Pty) Ltd, its directors, employees, and agents shall not be held liable for any direct, indirect, incidental, or consequential damages, losses, or expenses arising from:

  • The use or inability to use this website.

  • The performance or non-performance of livestock after delivery.

  • Incubation variances or failed hatch rates of fertile hatching eggs.

  • Delays in delivery caused by acts of God, severe weather, traffic, or veterinary movement restrictions.

7. Privacy and Data Protection (POPIA)

  • We value your privacy. Any personal information collected through our website, quote requests, or invoice generation will be processed in strict accordance with the Protection of Personal Information Act (POPIA).

  • Your data will only be used to process orders, facilitate deliveries, manage accounts, and communicate relevant business updates. We will never sell or distribute your information to unauthorized third parties.

8. Amendments to These Terms

The Company reserves the right to amend, update, or modify these Terms & Conditions at any time without prior notice. Any changes will become effective immediately upon being posted to this webpage. It is the customer's responsibility to review these Terms periodically.
